1. Introduction

These Terms of Use ("Terms") govern your use of the website and services operated by 2 Michaels Production ("we," "us," or "our"), a commercial videography, photography, and content production studio based in Ontario, Canada. By accessing, browsing, or engaging our services through this website, you agree to be bound by these Terms. If you do not agree, please discontinue use of the site.

2. Services

2 Michaels Production provides commercial videography and photography services, including brand films, corporate videos, training and safety videos, product photography, commercial spots and advertisements, event coverage, documentary content, social media content, and related post-production services such as editing, color grading, scriptwriting, narration, and voiceover. Specific deliverables, scope, turnaround times, and pricing for each project are outlined in the individual service agreement or contract executed with each client. In the event of any conflict between these Terms and a signed contract, the signed contract shall prevail.

3. Bookings & Deposits

• All production bookings are confirmed only upon receipt of a signed agreement and the required deposit.
• Deposits are non-refundable and reserve your production dates on our schedule.
• The remaining balance is due according to the schedule outlined in your signed contract.
• Shoot dates and editing timelines are subject to availability and are not held until the deposit is received.

4. Cancellations & Rescheduling

If you cancel your production booking, your deposit will not be refunded. Rescheduling requests will be considered on a case-by-case basis and are subject to availability. If we must cancel due to illness, emergency, or circumstances beyond our control, we will make every reasonable effort to provide a qualified replacement crew or reschedule the production, or refund any payments made for services not yet rendered.

5. Deliverables

• Turnaround times are estimates and may vary depending on the scope, length, and complexity of the project.
• Final edited videos and images are delivered via download links or specified hosting platforms as outlined in your agreement.
• Raw, unedited footage and original camera files are not included unless explicitly stated in your contract.
• We retain creative discretion over editing style, color grading, sound design, and final asset selection.
• Revisions are limited to the number of revision rounds specified in your contract; additional revisions may incur additional fees.

6. Usage & Licensing Rights

Unless otherwise specified in your contract, clients receive a license to use the delivered video and image assets for the purposes and channels agreed upon — which may include web, streaming, social media, broadcast, print, out-of-home, or internal training use. 2 Michaels Production retains the copyright to all video footage and photographs and reserves the right to use them for portfolio, marketing, social media, advertising, and competition purposes unless the client has purchased a separate confidentiality or embargo agreement in writing. Broad or unlimited usage rights, perpetual licenses, and full copyright transfers must be negotiated and documented in writing.

7. Client Responsibilities

• Provide accurate project briefs, scripts, and creative direction in advance of production.
• Obtain necessary permits, location releases, and permissions for filming at all locations.
• Secure talent, model, and appearance releases for all individuals featured in the content.
• Provide timely feedback and approvals to keep production and editing timelines on schedule.
• Ensure a safe and accessible working environment for our crew and equipment.

8. Drone & Aerial Footage

Drone footage is included in select packages and is subject to weather conditions, location permissions, and Transport Canada regulations. We are not liable for the inability to capture drone footage due to factors outside our control. No refund or discount will be issued when drone footage is not possible due to safety or regulatory restrictions.

9. Third-Party Assets & Clearances

The client is responsible for securing the rights to any third-party music, stock footage, logos, trademarks, or copyrighted material they request to be included in the production. 2 Michaels Production is not liable for copyright or trademark infringement arising from client-supplied assets. We can assist with sourcing licensed music and stock media at the client's expense when requested.

10. Limitation of Liability

2 Michaels Production is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim arising out of or relating to our services is limited to the amount paid by the client for the specific services at issue. We are not responsible for lost footage due to equipment failure, though we take extensive measures including backup equipment, dual recording, and secure data handling where applicable.

11. Website Use

You may not reproduce, distribute, or exploit any content from this website, including videos, images, text, or design elements, without our prior written consent. Unauthorized use of any content is a violation of copyright and may result in legal action.

12. Third-Party Links

This website may contain links to third-party websites and social media platforms. We are not responsible for the content, privacy practices, or policies of those external sites and encourage you to review their terms independently.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the website after changes constitutes acceptance of the revised Terms.
